Terms and Condution

TERMS OF DELIVERY

Outside the Netherlands: shipping costs are borne by the customer.

Within the Netherlands: Orders under € 150 net will be increased by € 8.50 in administration and shipping costs. Minimum order is € 50 net of products. PLEASE NOTE orders under € 50 excluding VAT will not be processed.

Ecuri Cosmetics retains ownership of all delivered products as long as the buyer has not fulfilled all his payment obligations.

Cash on delivery surcharge of € 20.00 is calculated. Prepayment and payment via iDeal is without surcharge.

 

RECEIPT OF GOODS
Upon delivery of the order, the Customer will check the conformity and condition of his order in the presence of the carrier and, if necessary, make any necessary reservations regarding the visible shortcomings (missing product, damaged package).
The Customer is requested to contact Ecuri Cosmetics within fourteen (14) calendar days after receipt of the products. Unless justified, any complaint made after that period will be considered inadmissible.

Returns can only be taken back after prior consultation, unstamped returns are not accepted.

 

GENERAL CONDITIONS FOR THE PROGRAMS OR MASTER CLASSES

Contract & payment and delivery conditions

Customer will receive a confirmation or invoice after registration. In the case of starter sets / training courses, the Customer can pay the costs of a training in installments or by payment in one go. The information about this can be found on our website. In that case, the Client must indicate the chosen method of payment when registering for a Training and this cannot be changed after registration for a Training. Payment must be made no later than before the start of the Training. Without prejudice to its other obligations, the Client owes statutory interest on the outstanding amounts from the due date of the invoice until the day of full payment. If the Client has opted for payment in installments and does not fulfill its payment obligation, then all payment terms are immediately due and payable from the moment the Client is in default. The Client is obliged to pay at all times, even if he or she has specified another party (for example his / her employer) as the paying party.

Reflection period and cancellation conditions

The customer has a cooling-off period of 14 days after the registration date.

When the course starts within 14 days of enrollment, you agree to waive the reflection period.

  • Cancellation is only possible in writing (letter, email)

  • Cancellation is free of charge up to 4 weeks (= 28 days) before the start of the course date.

  • If canceled 4 to 2 weeks (= 28 to 14 days) before the start of the course date, you owe 50% of the course fee.

  • In case of cancellation within 2 weeks (= 14 days) before the start of the course date or after the training has started, you will owe 100% of the course fee.

  • For courses lasting several days, you owe the full course fee, even if you are not able to attend all course days. This also applies if you have chosen to pay in installments.

 

Conditions under which the course may not take place

- Dropout teacher / exam assessor

  • In case of illness and / or absence of a teacher or an exam assessor, Ecuri Cosmetics will - as far as possible - provide an equivalent replacement. If replacement proves impossible, Ecuri Cosmetics will notify the Customer as soon as possible and come up with a proposal for alternative dates on which the relevant training will still be given, or the relevant Ecuri Cosmetics exam will still be taken.

  • In the event of illness and / or absence of a teacher or an exam assessor, the Client is not entitled to (damage) compensation. Ecuri Cosmetics will not charge extra costs for the care of class days resulting from illness and / or the absence of a teacher.

  • A Client cannot cancel a training or an exam free of charge due to the failure of a teacher or an exam assessor, or terminate the training agreement prematurely due to the failure of a teacher.

- in case of Calamities such as fire or flooding

 

RESTITUTION
Refunds will be granted within 4 weeks under valid conditions.

Proprietary Rights and Copyright

All intellectual property rights, including copyright, pertaining to the course material provided and compiled by Ecuri Cosmetics, rest with Ecuri Cosmetics. Nothing from these publications may be reproduced and / or made public without written permission from Ecuri Cosmetics.

Device remains the property of Ecuri Cosmetics until the total amount has been paid.

All information provided by customers and / or participants is confidential for Ecuri Cosmetics bv, its employees and the teachers.

GUARANTEE
 

NON-CONFORMITY AND HIDDEN DEFECTS
Ecuri Cosmetics is bound by the legal guarantee of conformity and its guarantee obligation regarding defects in the sold product
 

The Customer is obliged to check the conformity of the Products received as a result of his order and, in case of established shortcoming, to contact customer service who will handle the notification and inform him of the conditions. for return, replacement or refund.
Ecuri Cosmetics will proceed to the replacement or repair of the returned Product after receipt and examination of the Product in question.

 

Ecuri Cosmetics gives a warranty of 2 years for its products, on the understanding that the customer must report any defect to Ecuri Cosmetics after discovery or after this defect could reasonably have been discovered within a reasonable time, but no later than 14 days.
Ecuri Cosmetics will ensure that the product is repaired, if recovery is not possible, Ecuri Cosmetics will provide replacement of the product.

 

If replacement of the equipment is not possible, the customer has the right to dissolve the agreement with regard to the product in question, unless the deviation does not justify this dissolution and its consequences in view of its minor significance, or to reduce the price in proportion. with the degree of deviation.

 

EXCLUSION OF WARRANTY
If the products returned by the customer do not correspond to the ordered products or have a different origin than the direct sale by us, Ecuri Cosmetics is not bound by its obligations described above.

 

If the product is damaged after delivery (for example, the customer drops the product, the product undergoes water damage), Ecuri Cosmetics is not bound by its obligations.

Products with limited shelf life and consumables are excluded from a 2-year warranty, customer must check all purchased products after receipt of the products, in order to report defects to Ecuri Cosmetics within 14 days.

COMPLAINTS PROCEDURE
Complaints procedure Ecuri Cosmetics

 

Article 1
The following definitions apply in these regulations:
1. Training institute: Ecuri Cosmetics, located Lisbaan 15, 2908LN Capelle aan den IJssel
2. Complainant: an (ex-) student, an (ex) client, etc.
3. Complaint: Formally expressed dissatisfaction with a service provided or with behavior and decisions or failure to act and not taking decisions by Ecuri Cosmetics.
4. Contact person: Director of Ecuri Cosmetics.

 

Article 2
1. The complainant has the right to submit a complaint to Ecuri Cosmetics about conduct and decisions or the failure to act and not take decisions.
2. An act and decisions or the failure to act and not take decisions of a person working under the responsibility of Ecuri Cosmetics is regarded as an act of Ecuri Cosmetics.

 

Article 3
Ecuri Cosmetics ensures proper handling of complaints about behavior and decisions or the failure to act and not making decisions by Ecuri Cosmetics as well as those who work or were working under the responsibility of Ecuri Cosmetics.

 

Article 4
1. A complaint must be submitted in writing.
2. The notice of complaint is signed and contains at least:
the name and address of the submitter
b. the date
c. a description of the behavior and decisions or the failure to act and the failure to take decisions against which the complaint is directed.

 

Article 5
As soon as Ecuri Cosmetics has met his complaint to the satisfaction of the complainant, the obligation to continue to apply this complaints procedure will lapse. In that case, Ecuri Cosmetics will confirm the agreed compensation in writing to the complainant. This in turn signs the allowance for approval and then returns it to Ecuri Cosmetics.

 

Article 6
Ecuri Cosmetics will confirm receipt of the complaint in writing within 10 working days.

 

Article 7
The complaint is handled by Ecuri Cosmetics.

 

Article 8
Ecuri Cosmetics is not obliged to handle the complaint if it relates to behavior and decisions or the failure to act and not to take decisions:
a. about which a complaint has already been submitted that has been handled with due observance of this complaints procedure
b. that took place more than a year before the complaint was submitted
c. against which the complainant can or has lodged an appeal
d. which by instituting proceedings is or is subject to the judgment of a court other than an administrative court.

 

Article 9
A copy of the notice of complaint as well as of the accompanying documents will be sent to the person whose conduct the complaint relates to.

 

Article 10
1. Ecuri Cosmetics gives the complainant and the person to whose behavior the complaint relates the opportunity to be heard.
2. Hearing the complainant can be waived if the complaint is manifestly unfounded or if the complainant has stated that he does not wish to exercise the right to be heard.
3. A report is made of the hearing.

 

Article 11
1. Ecuri Cosmetics will handle the complaint within 4 weeks after receipt of the complaint.
2. Ecuri Cosmetics can postpone the settlement for a maximum of four weeks. The complainant and the person to whose conduct the complaint relates will be notified in writing of the adjournment.
3. Further postponement is possible if the complainant agrees to this in writing.

Article 12
1. Ecuri Cosmetics will inform the complainant in writing and with reasons of the findings of the investigation into the complaint, its opinion thereon as well as any conclusions it draws from it.
2. The notification states that if the complainant does not agree with the handling of the complaint, he can indicate this in writing within six weeks.
3. If the student does not provide a satisfactory answer, it is possible to engage an independent third party. The complaint will then be submitted to Mr. JB van Rij (former attorney in Rotterdam) who will make an independent and binding decision on the case. 4. A student who does not act in the exercise of a profession or business can - in deviation from paragraph 2-6 - within six weeks after Ecuri Cosmetics has invoked this dispute resolution scheme in writing, choose to submit the dispute to the judge competent according to the law. After this, this right will lapse.
5. The decision of the Complaints Committee is binding on all parties.
6. Without prejudice to the above provisions, all rights of action and other powers of the student for whatever reason against Ecuri Cosmetics - and against the third parties involved by Ecuri Cosmetics in the implementation of the Training Agreement - in connection with the work performed will lapse, at least twelve months after the time at which the student became or could be aware of this.
7. Any liability of Ecuri Cosmetics will in any case lapse no later than twelve months after the work has been performed.

 

Article 13
Ecuri Cosmetics ensures registration of the submitted written complaints.

If the complainant does not agree with the handling of the complaint, he will have to indicate this in writing within six weeks. In that case, the complaint will be handed over to an independent mediator to be appointed jointly with the complainant.

 

The result of the mediator's mediation is binding for all parties.
